Residential Real Estate Transactions
The Real Estate Transaction.
Once a homeowner decides to sell his or her home, they generally list their home with a real estate broker. Once the property is listed a potential buyer will make a formal offer that is secured by a deposit. If the property owner accepts the offer, a formal acceptance is signed that creates a binding contract to sell. The buyer and seller then begin to negotiate a purchase and sale agreement, (or "P&S"). A P&S is a legally binding contract commits both the buyer and seller to the transaction and explains what both parties rights and obligations are regarding the sale of the property.
Why Hire A Real Estate Attorney?
Like any major contract, the P&S should always be reviewed by an experienced attorney. Once the P&S is signed, both parties are legally bound by the terms of that document. While you might think that the P&S is clear on its face, it may contain provisions that are unenforceable or create more liability than you expected. Having an attorney review the P&S is a good idea since it trying to litigate your rights under the P&S could take years and cost you thousands of dollars. We work for you and promise to look out for your interest. Whether you are buying or selling a condominium, house, or land, we offer affordable flat rates and several closing packages that are tailored to meet your needs. Moreover, we offer a free consultation, so you can ask questions and get the facts before you pay anything. So Call Us today for more information.
Why Can't My Realtor Review the P&S?
Your Realtor specializes in helping you buy or sell your home, they are not qualified nor are they permitted to offer you legal advice. However, the main reason you should not rely on your Realtor to review or draft your P&S is that your Realtor is an interested party in the sale of a piece of real estate. This means that a Realtor only gets paid if there is a sale, so it is in their interest to ensure a sale, even if the terms of the sale are not in your best interest. Hiring an attorney guarantees that you get an expert, unbiased explanation and opinion of the contract. Moreover, your real estate attorney will work to negotiate fair and reasonable terms on the P&S and will represent you in the closing.

BUYERS For most people, purchasing a home is their most expensive lifetime endeavor. While many people are willing to pay a real estate broker to find a desirable residence and a home inspector to check its structural integrity, buyers occasionally make the serious mistake of signing Offers to Purchase and Purchase and Sale Agreements without first seeking the advice of counsel. Do not allow real estate brokers or sellers to pressure you into signing any Offer to Purchase or Purchase and Sale Agreement. Allow us to: · review and redraft, if necessary, the proposed Offer to Purchase and Purchase and Sale Agreement to ensure your deposit is protected; · Draft adequate contingencies regarding such items as inspections, financing and fixtures/appliances included in the purchase and a builder's warranty in the case of new construction; · Prepare specific language covering additional issues to be addressed by the parties; and, · Protect your investment by "homesteading" your property.
Buyers should know that there are restrictions placed on real estate brokers with regard to drafting contracts. Real estate brokers may know how to advertise and sell property or how to fill in blanks on standard forms; but, they are not lawyers whose sole responsibility is to protect the client/buyer and preserve and protect your rights if something goes wrong.

Moreover, our clients can avail themselves of our title examiners, attorneys, surveyors, home inspectors and more!
Sellers
All too often real estate brokers advise sellers that they do not need to involve a lawyer to "simply sell" their home. This is not true. Sellers should not allow real estate brokers to expose them to liability by preparing so-called "standard" form Offers to Purchase and Purchase and Sale Agreements. It is also sellers' responsibility to provide a deed transferring clear, marketable title to buyers at the time of closing. Moreover, for some sellers the pending purchase of a new home may be contingent upon funds derived from the sale of their present residence. So-called "piggy-back" transactions are complicated and require special provisions and attention. Allow us to: · review Offers to Purchase and Purchase and Sale Agreements prior to execution; · prepare and draft any necessary provisions and address the contingencies to ensure the integrity of the sale; · draft a deed in compliance with the requirements of Massachusetts law; and, · represent you at the time of closing under a power of attorney should you be unable to attend in person.
We have earned a reputation for following the rules - we do not "cut corners" or allow others to cut corners at the expense of our clients. The Massachusetts Conveyancers Association sets standards governing conveyancing practices in the Commonwealth and we do our utmost to uphold every aspect of those principles.
THIS IS WHY WE ARE CONSIDERED ONE OF THE BEST CLOSING AGENTS IN THE INDUSTRY!
